MOMally ("Company," "we," "us," or "our") operates MOMally.com and provides pediatric sleep consulting, postpartum doula services, lactation counseling, and related early parenting support services (collectively, the "Services"). This Privacy Policy describes how we collect, use, disclose, retain, and protect personal information obtained through our website, email communications, third-party scheduling and telehealth platforms, and direct client engagements.

This Policy applies to all visitors, prospective clients, and current or former clients. By accessing our website or engaging our Services, you agree to the practices described in this Policy.

This Policy does not apply to third-party websites, platforms, or services that may be linked to or integrated with MOMally.com, each of which operates under its own privacy practices.

Information We Collect

a. Information You Provide Directly

  • Contact information: name, email address, phone number, mailing address
  • Account and scheduling information: appointment preferences, intake form responses, availability
  • Client-provided content: sleep logs, feeding schedules, family and household information, child health and developmental information shared in the course of receiving Services
  • Payment information: billing address and transaction records (payment card data is processed by third-party payment processors and is not stored by MOMally)
  • Communications: emails, messages, and other correspondence you send to us

b. Sensitive Information

In the course of providing Services, you may voluntarily share information about your child's health, development, feeding practices, medical history, or related matters. This information is used solely to provide and improve the Services you have requested. We do not sell or share this information with third parties except as described in Section 5 of this Policy.

MOMally is a sleep consulting and postpartum support service, not a medical or clinical practice. Information shared with us is not subject to HIPAA protections unless we are operating under a formal Business Associate Agreement with a covered entity. If you engage with us through a platform subject to HIPAA (such as Maven Clinic), that platform's privacy practices and applicable agreements govern the handling of your health information within that platform.

c. Information Collected Automatically

When you visit MOMally.com, we and our third-party service providers may automatically collect device and browser information, usage data, IP address and approximate geographic location, and cookie and tracking technology data. This information is collected using tools including Google Analytics and is used to operate, maintain, and improve our website.

We use the personal information we collect for the following purposes:

  • To communicate with you regarding appointments, follow-up notes, resources, and service updates

We share information with third-party vendors who perform services on our behalf, including website hosting (Squarespace), scheduling (Acuity Scheduling), payment processing, email marketing, and analytics. These providers are authorized to use your information only as necessary to provide services to us and are bound by confidentiality obligations.

b. Platform Partners

If you engage with us through a third-party platform such as Maven Clinic, that platform's privacy policy and data practices govern information shared within that platform. We may receive session notes and related information from such platforms as part of our clinical workflow.

c. Legal Requirements

We may disclose your information if required by law, regulation, court order, or governmental authority, or when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, or investigate fraud.

d. Business Transfers

In the event of a merger, acquisition, sale of assets, or other business reorganization, your information may be transferred to the successor entity, subject to the same privacy protections described in this Policy.

e. With Your Consent

We may share your information for any other purpose with your prior written consent.

Third-Party Platforms and Integrations

Our Services are delivered in part through third-party platforms including but not limited to Squarespace, Acuity Scheduling, and Maven Clinic. Each of these platforms maintains its own privacy policy and data security practices. We encourage you to review the privacy policies of any third-party platform through which you interact with MOMally.

Data Retention

We retain your personal information for as long as necessary to fulfill the purposes described in this Policy, maintain our business records, and comply with applicable legal obligations. Client records are generally retained for a minimum of three (3) years following the conclusion of our engagement. You may request deletion of your information at any time, subject to our legal retention obligations.

Data Security

We implement commercially reasonable administrative, technical, and physical safeguards to protect your personal information from unauthorized access, disclosure, alteration, or destruction. Our website uses SSL (Secure Sockets Layer) encryption for data transmitted through the site.

No method of transmission over the internet or electronic storage is completely secure. While we strive to protect your personal information, we cannot guarantee its absolute security. Email communication, in particular, is not a secure medium. Please do not send sensitive personal or health information by email.

In the event of a data breach that affects your personal information, we will notify you as required by applicable law.

Children's Privacy

MOMally.com is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If we become aware that we have inadvertently collected such information, we will delete it promptly. If you believe we may have collected information from a child under 13, please contact us at andrea@momally.com.

Although our Services concern the care and sleep of infants and young children, all personal information is collected from and about the parent or guardian engaging our Services, not the child directly.

EU residents will be enrolled in marketing communications only upon affirmative consent.
